I accept a $300.00 deposit to hold a kitten until it is old enough to leave, or in some cases until you can pick it up at my house. I do not meet people part ways, and I will not hold a kitten indefinitely whether it is paid in full or not. A boarding fee of $20.00 per day will be applied and paid, before you get your kitten, if you do not pick up within the agreed amount of time stated at time of purchase agreement. In the event, you do not come to pickup your kitten on time, I will place the kitten for resale, and you forfeit your deposit and any monies paid will go toward boarding fees.
The purchaser has 3 days after receiving the cat/kitten to have it examined by a licensed veterinarian. If the vet finds a life threatning disease at this time, the kitten will be exchanged for another of equal value, providing I am notified immediately after the vet visit, a letter from examining veterinarian is supplied to me, and buyer returns the kitten to me within 5 days of vet exam. All shipping costs for return of kitten, and shipping of replacement kitten are paid buy the buyer. After the 3 day period, the seller cannot be held responsible for future diagnosis of FIP/FIV/FELV, parasites or fungus. These can be contracted anywhere and are not congenital. All kittens are vet checked prior to shipping, and will recieve a health certificate for flying.
All shipping fees will be payed by the buyer. The seller is not responsible for lost or stolen pets after the airline accepts the animal, or any addtional fees that airline require due to late flights. The buyer must file a claim with the airline for lost or stolen items, including a deceased kitten. The buyer is responsible for alerting me to the fact you want to declare a value to the airline. The airline charges an extra fee for declaring values above $500.00.
I do not guarantee any cat/kitten to do well in the show ring. I do not guarantee show quality for any kitten. It is understood the breeder will not pay any fees of any kind including vet fees at first appointment for any reason, that the buyer may incur from the purchase date until infinity. If the buyer chooses to vaccinate against FELV, FIV, FIP, or ringworm, the one year replacement guarantee is null and void, and the breeder will not accept the kitten as a return. The breeder does not guarantee against future reactions to vaccinations.
If this kitten should expire by it's first birthday, an autopsy must be provided stating the cause was hereditary, for a replacement kitten to be given. A comparable kitten will be provided within 6 months.The seller assumes no responsibility for medical expenses for any reason. It is further understood and agreed no warranty has been made with respect to sold kitten except as set forth in this agreement. I do not guarantee fertility. Many factors can cause a fertile cat go go infertile, including herpes, pyometra, and other illnesses that I cannot be responsible for once the kitten leaves my home. No cash refund will be given for any reason. All deposits are non refundable, no exceptions. Hairlessness may vary from season to season due to temperatures and shorter days, or as kitten matures. I am not responsible for fuzz, or hair, although we are breeding for the baldest kittens possible. I do not give replacements due to any cosmetic issues, small or large size, hair or fur growth, bad behavior, poor training on your part, or anything that doesn't affect the life span of the cat. I only give replacements for genectic health problems causing death by the age of 1 year.
Kittens sold as pets must be spade/neutered by 6 months of age unless stated in the contract it was sold as a breeder/show kitten. This is not negotiable. I the purchaser,______________________________ agree to have the kitten/cat spade/neutered within this time frame, or I will forfeit the cat to the breeder upon her request, and pay the shipping for delivery of the cat to her. A fee of $700.00 for breach of contract will also be charged. If the breeder must contact the buyer to obtain a spay/neuter certificate if it is late, the buyer has 7 days to submit one by email, or fax to 813-762-8885. If one has not been recieved on the 8th day, the account will be turned over to Fidelity Collection Agency to obtain the $700.00 fee. After 60 days with no payment, the account is reported to all three credit bureas. It is the buyers responsibility to provide proof of alteration to the breeder by 6 months of age. Only then will registration papers will sent, and paper will be marked not for breeding or showing. Even if you do not want the registration papers, YOU MUST PROVIDE PROOF OF SPAY/NEUTER. When purchasing a retired adult, no registrations paper will be given to new owners. This is due to the false practice of people using the paperwork to register unrelated kittens. This practice is known as hanging papers. The breeder/owner will retain all papers belonging to any cat or kitten preregistered with full rights. If there is any breach of this contract by the buyer, the 1 year health guarantee is null and void.
We the undersigned, consider this document to be a legal and binding contract. By signing this document, you are voluntarily giving Washington County Maryland Circuit Court full jurisdiction to hear any unresolved disagreements directly related to the sale of this cat/kitten. All disagreements will be settled in Washington County Circuit Court of Maryland, and court fees, certified mail charges, and lawyer fees, including loss of work, will apply. By signing this contract, you are stating that you have read, understand and agree to all terms set forth within this contract, and no other verbal or written guarantee exist.
